We run an e-shop on the website www.ellarte.com

 

When selling goods and operating our website, we process some personal data.

 

The processing of personal data is governed in particular by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 with regard to the processing of personal data and on the free movement of such data, and repealing 95/46/EC (General Data Protection Regulation) ("GDPR").

Processing of personal data in the case of using the contact form

If you contact us in connection with our products and services, we will work with your contact details that you provide to us, especially through the contact form. These are personal data in the following scope: Name and surname, address and contact details (e-mail, phone number)

For what reason?

Based on the personal data sent, we will then contact you in connection with our offer of goods.

On what legal basis?

This is processing on the basis of Article 6(1)(b) of the GDPR – performance of a contract, or the implementation of measures prior to the conclusion of a contract at your request.

If you do not provide us with this personal data, we will not be able to communicate with you for the purpose of concluding a contract for the supply of our goods or services.

How long will we process personal data?

Unless we establish further cooperation, we will process your personal data for a maximum of 10 calendar years from our last communication.

 

Processing of personal data in case of purchase

If you make a purchase from us, we will work with the personal data that we need from you to ensure the conclusion of a contract for the provision of our goods or services. These are mainly invoicing data: name, surname, address, contact details

For what reason?

We need to process personal data in order to be able to fulfil our obligations under the contract – delivery of goods. Using our contact details, we will also communicate with you about the status of your order, or about complaints or your questions.

We will further process personal data for the fulfilment of our obligations arising from generally binding legal regulations (mainly for accounting and tax purposes, or for handling complaints.

On what legal basis do we process personal data?

This is processing based on Article 6(1)(b) of the GDPR – performance of a contract and Article 6(1)(c) of the GDPR – fulfilment of our legal obligation.

If you do not provide us with this personal data, we will not be able to conclude a contract with you for the supply of our goods or services.

How long will we process personal data?

During the delivery of goods or provision of services and then 10 years from the last delivery of the goods.

 

Newsletter (commercial communication)

If you have purchased goods or services from us and have not explicitly opted out of receiving marketing communications, we will use your email address to send you our marketing communications.

On what legal basis?

This is a processing based on Article 6(1)(f) of the GDPR – our legitimate interests, which are marketing communications targeted at our customers.

How long will we process personal data?

10 years since your last purchase. If you no longer wish to receive marketing communications from us, you can unsubscribe at any time via email or you can contact us at: info@ellarte.com

  1. Who will access the data?

Your personal data will remain with us. Nevertheless, some companies or other persons work for us who have access to your personal data because they help us run our e-shop. These are:

  1. operator of the Shoptet e-shop platform (Shoptet a.s., with its registered office at Dvořeckého 628/8, Břevnov, 169 00, Prague 6, Czech Republic, ID No.: 289 35 675, registered at the Municipal Court in Prague, Section B, Insert 25395)
  2. companies involved in the dispatch of DPD goods and other courier companies
  3. companies involved in the dispatch of GoPay payments
  4. E-mailing service provider contractually bound to our company
  5. Marketing agency contractually bound to our company

It is possible to object to processing on the basis of a legitimate interest.
